Boston Pizza Royalties Income Fund and Boston Pizza International
Announce Injunction Decision At Federal Court of Canada

VANCOUVER, BC, April 3, 2003 – Boston Pizza International Inc. ("BPI or Boston Pizza") and Boston Pizza Royalties Income Fund (TSX: BPF.UN) (the "Fund") announced today that the Federal Court of Canada, rendered a ruling dismissing an application for an injunction sought by BPI and Boston Pizza Royalties Limited Partnership (the "Partnership"), a subsidiary of the Fund, against Boston Market Corporation, Global Restaurant Operations of Ireland Limited, Boston Market Canada Company, and McDonald’s Restaurants of Canada Limited (the "McDonald’s Group").

BPI and the Partnership had applied to stop the McDonald’s Group from opening further "Boston Market" restaurants in Canada pending trial of BPI’s and the Partnership’s claim for trademark infringement. The Federal Court-Trial Division declined to grant the injunction primarily on the grounds that it was not satisfied that irreparable harm would result to BPI and the Partnership if the injunction were not granted. The Court reasoned that BPI and the Partnership could be adequately compensated by an award of monetary damages if their claims were ultimately successful at trial. The Court expressly stated that the dismissal of the injunction application was not based upon any finding as to the ultimate merits of the trade-mark infringement claims made by BPI and the Partnership. BPI and the Partnership are in the process of setting a date for the trial of this matter, which is expected to commence in late 2004.

"Boston Chicken" and "Boston Market" are not currently registered trademarks in Canada, due to the successful efforts of BPI and the Partnership in opposing their registration. In response, the McDonald’s Group is now attempting to challenge the validity of the registration of the "Boston Pizza" and related trademarks in Canada, including a trademark that has been used by BPI and predecessor entities for over 30 years and was registered under the Trade-Marks Act (Canada) in 1970.

BPI and the Partnership, owner of the Boston Pizza trademarks, will continue to oppose the McDonald’s Group application to register "Boston Market" as a trademark in Canada, and will pursue all elements of this action vigourously.

The Fund is a limited purpose, open-ended trust established under the laws of British Columbia to acquire indirectly certain trademarks and trade names used by BPI in its Boston Pizza restaurants in Canada. The trademarks are licensed by the Boston Pizza Royalties Limited Partnership to BPI for 99 years for which BPI pays the Fund 4% of franchise revenues from its 162 Boston Pizza restaurants in Canada as at November 1, 2002.
